Terms & Conditions
1. Scope
These terms apply to all quotations, orders and services provided by Nonkonformer GmbH, Kesselstrasse 15, 8957 Spreitenbach, Switzerland. Deviating agreements apply only if confirmed by us in writing.
Our work generally takes the form of a contract for work and services under Art. 363 ff. of the Swiss Code of Obligations: we design, produce and, where agreed, install bespoke objects, installations and printed works.
2. Quotations and orders
Quotations are valid for 30 days from the date of issue unless stated otherwise. A contract comes into effect once we confirm the order in writing.
The agreed specification, drawings, samples or approved visualisations form part of the contract. Changes requested after approval may affect the price and the delivery date and will be invoiced separately.
3. Availability and lead times
We take care to state lead times accurately. Delays may nevertheless occur, in particular due to production or supply constraints. Information on availability and lead times is therefore given without guarantee and may change.
We are not liable for delays caused by circumstances beyond our control, including supply shortages, transport disruption, official measures or force majeure.
4. Prices and payment
All prices are in Swiss francs and exclude VAT unless stated otherwise. Costs for transport, installation and any special packaging are quoted separately.
Payment terms are set out in the individual quotation or order confirmation.
If the client fails to pay within the agreed period, all outstanding amounts owed to Nonkonformer under any title fall due immediately. We may suspend further work and deliveries until payment is received. Default interest applies at the statutory rate.
5. Delivery, collection and transport damage
Unless agreed otherwise, delivery takes place from our premises in Spreitenbach. Collection in person is possible during business hours, by prior arrangement and against presentation of our collection confirmation.
Please inspect the packaging carefully on receipt. If it is damaged, accept the delivery subject to reservation, notify us without delay, and include a photograph of the unopened packaging. Transport damage reported later cannot be considered.
6. Acceptance and defects
On completion, the client shall inspect the work and confirm acceptance. Defects must be notified immediately in writing.
Where a defect exists, the client is entitled to rectification free of charge. Further claims are excluded to the extent permitted by law. The warranty period is stated in the individual quotation or order confirmation.
Variations in colour, surface, texture and dimensions that are inherent to the production processes used — including 3D printing, CNC machining, large-format printing, painting and hand finishing — do not constitute defects.
7. Liability
Our liability is limited to the value of the order concerned. Liability for indirect damage, consequential loss and loss of profit is excluded.
Liability for intent and gross negligence, as well as any liability that cannot be excluded by law, remains unaffected.
8. Intellectual property and confidentiality
All texts, images, drawings, models and project documentation on this website and produced in the course of our work are the property of Nonkonformer GmbH or are used with permission. Any reproduction, distribution or use beyond the limits of copyright law requires our prior written consent.
Rights of use in designs, 3D data and production files are governed by the individual agreement.
We treat all client information and project details as confidential.
9. Cancellation
Under Art. 377 of the Swiss Code of Obligations, the client may withdraw from the contract at any time before completion, against compensation for work already performed, materials procured and other expenses incurred, as well as full indemnification of Nonkonformer.

11. Applicable law and jurisdiction
Swiss substantive law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980.
The exclusive place of jurisdiction is Baden, Canton of Aargau, Switzerland. Mandatory places of jurisdiction are reserved.
