Applicable Law

This privacy policy follows the revised Swiss Federal Act on Data Protection (FADP) and its implementing ordinance.

Where the European General Data Protection Regulation (GDPR) applies to our processing — for instance because we provide services to clients in the European Economic Area or specifically address individuals there — we comply with its requirements as well. The rights set out below apply accordingly.

Principles

We process personal data lawfully, in good faith and proportionately. We collect only the data required for the stated purpose, and retain it no longer than necessary.

Personal data means any information relating to an identified or identifiable natural person.

Server Log Files

When you visit this website, our hosting provider automatically records technical data in server log files: IP address of the accessing device, browser type and version, operating system, referrer URL, date and time of the request, volume of data transferred and status code.

This data serves the secure and stable operation of the website, error diagnosis and the prevention of misuse. It is not combined with data from other sources.

Contact Form, Email and Telephone

When you contact us via the contact form, by email or by telephone, we process the information you provide — typically name, company, email address, phone number, project details and any files you upload — in order to handle your enquiry and any follow-up questions.

Your enquiry and the related correspondence are stored in our CRM system.

Newsletter

If you subscribe to our newsletter, we process your email address in order to send you information about our work and services. Subscription is voluntary and can be withdrawn at any time, via the unsubscribe link in every message or informally by email to info@nonkonformer.ch.

Client and Project Data

In connection with quotations, orders and their execution, we process the data required for that purpose: contact and invoicing details, project documentation, technical files such as 3D data and drawings, correspondence and payment information.

Business records are subject to the statutory ten-year retention period under Art. 958f of the Swiss Code of Obligations.

Service Providers

This website is operated on the platform of Wix.com Ltd., Nemal Tel Aviv St. 40, Tel Aviv 6350671, Israel, and its affiliated companies, in particular Wix.com Inc. based in the United States.

On our behalf, Wix processes technical access data and server log files, information submitted through the contact form, contact data held in the CRM system, newsletter recipient data, and statistical usage data of the website.

Wix is contractually bound to process this data solely for the provision of the agreed services and in accordance with our instructions.

Transfers Abroad

The Swiss Federal Council recognises Israel and the EEA states as providing an adequate level of data protection. For transfers to the United States we rely on the Swiss-U.S. Data Privacy Framework where the provider concerned is certified, and otherwise on the Standard Contractual Clauses issued by the European Commission and recognised by the FDPIC.

Retention and Security

We retain personal data only as long as necessary for the relevant purpose. Server log files are kept for a few months, enquiries not leading to an order for up to 24 months after the last contact, newsletter data until you unsubscribe, and order and accounting records for ten years under Art. 958f of the Swiss Code of Obligations.

This website is protected by TLS encryption, recognisable by "https://" and the padlock symbol in your browser's address bar. We take appropriate technical and organisational measures to protect your data.

Please note that data transmitted over the internet, particularly by email, may be subject to security vulnerabilities. Complete protection against third-party access is not possible.

Your Rights

Within the scope of applicable law, you have the right to request information on whether and which personal data we process about you (Art. 25 FADP), to request correction of inaccurate data, to request deletion or restriction of processing, to object to processing, to request the release or transfer of your data in a common electronic format (Art. 28 FADP), and to withdraw consent at any time with effect for the future.
